Terms & Conditions

These Terms and Conditions ("Terms") govern your relationship with Smein Hosting N.V., the operator of the online gambling platform made available to certain users under the brand "Gamdom" via the website https://gamdombet-au.com (referred to in these Terms as "Gamdom", the "Platform", "Gamdom", "we", "us"). These Terms are effective from 1 January 2026 and apply to all access to and use of the Platform from that date.

Definitions

For the purposes of these Terms, the following definitions apply:

  • Operator means Smein Hosting N.V., a Curaçao incorporated company and holder of a sublicense under Curaçao master licence 365/JAZ (sub-licence GLH-OCCHKTW0702132020), which operates the Platform.
  • Platform means the gambling website and related services accessible at https://gamdombet-au.com, together with associated applications, interfaces and mirror URLs used from time to time.
  • User or Player means any natural person who accesses the Platform, whether or not they register an Account or place a Bet.
  • Account means a personal user account created on the Platform for the purpose of using the gambling and related services.
  • Services means the online gambling, gaming, "provably fair" games, skin gambling, casino games (including slots, table games and live casino) and associated features offered on the Platform.
  • Bet or Wager means any amount of real money, cryptocurrency, virtual credits, skins or other in-Platform items staked on the outcome of a Game or event offered on the Platform.
  • Game means any game, betting market, casino product or other gambling activity available on the Platform.
  • Bonus means any additional funds, credits, free spins, cashback, rakeback or other promotional value credited to an Account under a Promotion.
  • Promotion means any campaign, offer, tournament, loyalty reward or bonus scheme made available by the Operator from time to time.
  • KYC/AML Policy means the Operator's identity verification, anti-money laundering and counter-terrorism financing procedures described at https://gamdombet-au.com/legal/kyc-aml.
  • Restricted Territory means any country or jurisdiction where use of the Services is illegal or where the Operator, at its discretion, prohibits access. This includes Australia to the extent that use of offshore online gambling services is prohibited by the Interactive Gambling Act 2001 (Cth) or related regulations.
  • Applicable Law means the laws of Curaçao governing the Operator and, where relevant, any mandatory consumer or gambling laws applicable in the User's country of residence.
  • Self-Exclusion means a voluntary request by a User to restrict or permanently close their Account for responsible gambling reasons using the tools available on the Platform.

Account Registration

Eligibility and Age Requirements

  • Minimum age: You may only register and hold an Account if you are at least 18 years of age or the legal age for online gambling in your jurisdiction, whichever is higher. We may request evidence of age at any time.
  • Jurisdictional restrictions: You must not create or use an Account if you are located in a Restricted Territory. In particular, if you are in Australia, you must not use the Platform where doing so would contravene the Interactive Gambling Act 2001 (Cth) or any other applicable Australian law. These Terms must not be construed as an invitation to breach local law.
  • One Account per person: You may hold only one (1) Account. Duplicate Accounts may be closed and associated balances and Bonuses cancelled in accordance with these Terms.

Registration Process

  • Account creation: To register, you must provide a valid email address, create a secure password and supply any other information requested in the registration form.
  • Email verification: We may require you to verify your email address by clicking a link sent to you. Until verification is completed, access to certain Services (including withdrawals) may be restricted.
  • KYC/AML verification: In line with our KYC/AML Policy, we may at any time require documents such as:
    • Government-issued photo identification;
    • Proof of residential address (e.g. utility bill, bank statement);
    • Proof of ownership of payment methods and/or source of funds.
    Until satisfactory verification is completed, we may refuse registration, suspend the Account, or withhold deposits and withdrawals.

User Obligations

  • Accuracy of data: You confirm that all information you provide is true, complete and up to date and that you will promptly correct any changes, including contact details and residency.
  • Password and security: You are solely responsible for maintaining the confidentiality of your login credentials and for all activity carried out under your Account. You must:
    • Choose a strong, unique password;
    • Not share your credentials with any third party;
    • Immediately notify us if you suspect unauthorised access.
  • Use for own benefit only: You must use the Platform only on your own behalf and not as an agent or on behalf of any third party.
  • Compliance with law: You are responsible for ensuring that your use of the Platform is lawful in your jurisdiction. We do not provide legal advice and make no representation that the Services comply with the laws of any particular country, including Australia.

Betting & Gameplay Rules

Placing Bets

  • Offer and acceptance: A Bet is deemed accepted when it is recorded on our servers and appears in your Account's betting or transaction history. If there is any discrepancy between your on-screen balance and our server records, the server records shall prevail.
  • Minimum and maximum stakes: Each Game or market may specify minimum and maximum stakes. These limits may change without notice and are displayed in the relevant Game interface or rules.
  • Funding of bets: You may place Bets only with funds, cryptocurrencies, skins or virtual items that have been legitimately credited to your Account. Bets placed with funds obtained through error, chargeback, fraud or in breach of these Terms may be voided.

Cancellation and Modification of Bets

  • No cancellation by User: Once a Bet has been confirmed by our systems, you cannot amend or cancel it.
  • Operator's right to void: We may cancel or void a Bet, or a series of Bets, in whole or in part, where:
    • There is an obvious error (including typographical or technical odds/price errors);
    • A Game malfunction, connectivity failure or similar technical issue affects the outcome;
    • We have reasonable grounds to suspect fraud, collusion, match-fixing, bonus abuse, software exploitation or use of automated tools ("bots");
    • The Bet is prohibited by law or placed from a Restricted Territory.
    In such cases, our decision is final, subject to any applicable dispute resolution mechanism.

Conduct in Games, Live Casino and Chats

  • Fair play: You must not interfere with the normal operation of any Game, attempt to manipulate results or use any device, software or technique that confers an unfair advantage.
  • Chat behaviour: Where chat or social features are available, you must:
    • Refrain from harassment, threats, hate speech, discrimination, insults, or offensive language;
    • Not advertise or promote other services or websites;
    • Not encourage others to break the law, circumvent regulatory safeguards or misuse the Platform;
    • Not share personal or financial information of yourself or others.
  • Responsible gambling and self-exclusion: You are encouraged to use the responsible gambling tools available on the Platform, including the self-exclusion functionality accessible via: Profile → Transactions → Self-Exclusion. Self-exclusion periods range from six (6) months to permanent exclusion. During a self-exclusion period you must not attempt to open new Accounts or otherwise access the Services.

Bonus Terms

Activation of Bonuses and Promotions

  • Eligibility: Bonuses and Promotions are optional and may be subject to specific eligibility criteria (e.g. new Users only, minimum deposit, particular currency or country restrictions). Details are provided in the relevant offer.
  • Activation: To activate a Bonus you may need to:
    • Opt-in via the Platform interface;
    • Enter a promotional code; and/or
    • Meet a stated minimum deposit or wagering requirement.
  • Bonus credits: Bonus funds, free spins or other promotional benefits are credited to your Account in accordance with the specific Promotion rules and may not be withdrawn until all applicable conditions have been satisfied.

Wagering Requirements and Timeframes

  • General rule: Each Promotion sets out its own wagering requirements, contribution percentages, maximum bet per round, and validity period. You must carefully read the terms of each offer before participating.
  • Completion of wagering: Unless otherwise stated, Bonus funds, including winnings derived from them, are locked until the relevant wagering requirements are met in full within the specified timeframe.
  • Expiry: If wagering requirements are not met within the timeframe stated in the specific Promotion, the Bonus and any associated winnings may be forfeited.

Prohibited Games and Actions

  • Game restrictions: Certain Games or categories (for example, some table games, low-risk bets, or specific slots) may be excluded from wagering or contribute only partially towards wagering requirements. These restrictions are indicated in the Promotion terms.
  • Abusive behaviour: The following may be treated as Bonus abuse, resulting in cancellation of Bonuses, forfeiture of winnings and possible Account closure:
    • Placing minimal-risk or hedged bets to meet wagering requirements;
    • Using multiple Accounts or acting in collusion with others;
    • Deliberately delaying or manipulating Game rounds (e.g. saving free spins for later use contrary to intended mechanics);
    • Depositing and withdrawing immediately without genuine gambling activity.

Combination of Promotions

  • One active Bonus: Unless expressly allowed, only one Bonus or Promotion may be active on an Account at any time.
  • Priority of rules: In the event of conflict between these general Bonus Terms and the specific rules of a Promotion, the specific Promotion rules will prevail to the extent of the inconsistency.
  • No transfer: Bonuses and promotional rights are non-transferable and have no cash value unless and until wagering conditions have been satisfied.

Payments & Withdrawals

Deposits

  • Payment methods: Deposits may be made using payment options made available in the cashier section from time to time, which may include bank cards, e-wallets, cryptocurrencies and, where applicable, skins or virtual items. The availability of specific methods depends on your location and third-party provider policies.
  • Third-party restrictions: In some jurisdictions, including Australia, banks, card schemes and payment providers may block or reverse transactions to offshore gambling operators. We are not responsible for such actions and cannot guarantee that any particular payment method will be available or successful.
  • Ownership of funds: You may only deposit funds and value that belong to you and originate from legitimate sources. Third-party deposits are prohibited.

Withdrawals

  • General conditions: Withdrawal requests are subject to:

    • Compliance with wagering requirements, Bonus Terms and these Terms generally.
  • Payment methods for withdrawals: Wherever practicable, withdrawals will be made using the same method and to the same account or wallet used for deposit. We may, at our discretion, require an alternative method that we deem appropriate and compliant.
  • Processing times: We aim to review and process withdrawal requests within a reasonable timeframe. Actual receipt of funds will depend on the payment provider and may be affected by regulatory or banking restrictions, including those applicable in Australia.
  • Limits: We may apply minimum and maximum withdrawal limits per transaction, day, week or month. These limits will be communicated in the cashier or support section.

Refunds, Chargebacks and Reversals

  • Refund policy: Deposits are generally non-refundable once used for gambling. In exceptional circumstances and at our sole discretion, we may agree to a refund subject to appropriate checks and deductions for costs already incurred.
  • Chargebacks: If you initiate a chargeback, payment dispute or reversal, we may:
    • Block your Account;
    • Offset any amounts owed to us against your balance;
    • Recover any reasonable costs and expenses arising from the chargeback.
  • Erroneous credits: If funds are credited to your Account in error, you must notify us immediately and not use such funds. We are entitled to reverse the transaction and recover any amounts wrongly paid, including by debiting your Account or requesting repayment.

Limitation of Liability

Operator's Obligations

  • Provision of Services: We will provide the Services with reasonable skill and care and in accordance with these Terms and any applicable licence conditions under Curaçao law.
  • Game integrity: We seek to ensure that Games are fair and operate as described. Certain Games use "provably fair" mechanisms, the details of which are explained at https://gamdombet-au.com/provably-fair. Our systems and software may be tested or certified by independent providers where applicable.

Exclusions of Liability

  • Technical issues: To the maximum extent permitted by Applicable Law, we are not liable for:
    • Interruptions, delays or failures in telecommunications, internet connectivity or your hardware or software;
    • System errors, bugs or malfunctions that are promptly corrected and for which affected Bets are voided or refunded in accordance with these Terms;
    • Losses arising from your failure to keep login credentials secure.
  • Indirect loss: We are not liable for any indirect, incidental, special, punitive or consequential damages (including loss of profits, business, goodwill or data), whether in contract, tort or otherwise, arising out of or in connection with your use of the Platform.
  • Regulatory actions: We are not responsible for any loss or inconvenience resulting from regulatory actions taken by authorities such as the Australian Communications and Media Authority (ACMA), including access blocking, ISP filtering or payment blocking affecting the Platform.

Limitation of Damages

  • Maximum liability: Subject to any non-excludable rights under Applicable Law, our total aggregate liability to you in respect of any claim arising out of your use of the Platform shall not exceed the greater of:
    • The amount of the relevant Bet or Wager associated with the claim; or
    • The net amount of deposits you have made to your Account in the six (6) months immediately preceding the event giving rise to the claim.
  • Non-excludable rights: Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under Applicable Law, including (where applicable) liability for fraud or fraudulent misrepresentation.

Intellectual Property Rights

  • Ownership: All intellectual property rights in and to the Platform and Services, including but not limited to software, source code, algorithms, databases, graphics, logos (including "Gamdom"), trade names, text, audio, video, and other content, are owned by the Operator or its licensors.
  • Licence to use: We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial entertainment purposes only, in accordance with these Terms.
  • Prohibited uses: You must not, without our prior written consent:
    • Copy, reproduce, distribute, transmit, display, publish, modify or create derivative works from any part of the Platform or its content;
    • Reverse engineer, decompile, disassemble or otherwise attempt to access the source code of any software used on the Platform, except where such activity is expressly permitted by Applicable Law and only after providing prior written notice to us;
    • Remove, alter or obscure any copyright, trademark or other proprietary notices.

Privacy & Data Protection

  • Privacy Policy: Your personal data is collected, processed and stored in accordance with our Privacy Policy as amended from time to time. You should review the Privacy Policy carefully before using the Platform.
  • KYC/AML data: Information and documents provided under our KYC/AML Policy are processed for identity verification, fraud prevention and compliance with anti-money laundering and counter-terrorism financing obligations.
  • Data location: Your data may be stored and processed in Curaçao or other jurisdictions. By using the Platform, you consent to such international data transfers as described in the Privacy Policy.

Changes to Terms

  • Right to amend: We may update or modify these Terms from time to time, including to reflect changes in Applicable Law, licensing requirements or the Services offered.
  • Notice of changes: Where changes are material, we will seek to notify you in advance by one or more of the following methods:
    • Email to the address registered to your Account;
    • On-site banners, pop-ups or notifications upon login;
    • Publishing the updated Terms at https://gamdombet-au.com/legal/terms-of-service with a revised effective date.
  • Acceptance of changes: Continued use of the Platform after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree, you must cease using the Platform and may request closure of your Account and withdrawal of any eligible balance, subject to these Terms and Applicable Law.

Termination & Suspension

Our Right to Suspend or Close Accounts

  • Grounds for action: We may suspend or terminate your Account, restrict access to the Services, or cancel Bets and Bonuses where we reasonably believe that:
    • You have breached these Terms, any Promotion rules or our KYC/AML Policy;
    • You are underage or have provided false or misleading information;
    • You are located in or using the Services from a Restricted Territory (including where Australian law prohibits the provision of offshore gambling services);
    • There is suspected fraud, money laundering, terrorism financing, collusion, Bonus abuse or other unlawful activity;
    • A chargeback or payment dispute has been initiated;
    • We are required to do so by a regulator, law enforcement authority or court order.

Self-Exclusion and Player-Initiated Closure

  • Self-exclusion: You may at any time request temporary or permanent self-exclusion using the in-Platform tools (Profile → Transactions → Self-Exclusion), with available periods ranging from six (6) months to permanent exclusion. During self-exclusion you must not attempt to open new Accounts or access the Services.
  • Account closure: You may request closure of your Account by contacting customer support. We will process closure within a reasonable time, subject to completion of any outstanding investigations or regulatory requirements.

Consequences of Termination or Suspension

  • Funds handling: Upon closure (whether by you or us), we will, subject to any rights to withhold or confiscate funds under these Terms and Applicable Law:
    • Return any remaining real-money or cryptocurrency balance to you by an appropriate payment method; or
    • Where return is not legally or practically possible, handle funds in accordance with our legal obligations.
  • Bonuses and promotions: On termination, all unused Bonuses, free spins, loyalty points and promotional entitlements will ordinarily be cancelled and have no cash value.
  • Ongoing investigations: Where an investigation into suspected unlawful activity or serious breach is ongoing, we may freeze your Account and withhold funds until the investigation is concluded and any legal or regulatory directions have been complied with.

Governing Law & Jurisdiction

  • Governing law: These Terms, their subject matter and formation (and any non-contractual disputes or claims) are governed by the laws of Curaçao, without prejudice to any mandatory consumer protection laws in your country of residence.
  • Regulatory context: The Operator holds a sublicense under Curaçao master licence 365/JAZ (sub-licence GLH-OCCHKTW0702132020). Information about Curaçao's gambling supervision and reforms can be found at https://gamingcontrolcuracao.org. In Australia, offshore online gambling services may be classified as "illegal offshore gambling services" under the Interactive Gambling Act 2001 (Cth). The Australian Communications and Media Authority (ACMA) provides information on enforcement actions at https://acma.gov.au.
  • Dispute resolution: If you have a complaint, you must first contact our customer support and provide all relevant information. We will investigate and respond within a reasonable time. If you are not satisfied with the outcome and the dispute relates to gambling services regulated in Curaçao, you may be able to escalate the matter to the relevant Curaçao authority or an alternative dispute resolution body, where available.
  • Courts: Subject to any applicable alternative dispute resolution process, you agree that the courts of Curaçao shall have non-exclusive jurisdiction over any dispute arising from or relating to these Terms or your use of the Platform, without prejudice to any rights granted to you by mandatory law in your country of residence.
  • No encouragement of unlawful use: Nothing in these Terms should be interpreted as encouraging or permitting you to use the Platform from any jurisdiction where such use is unlawful, including Australia where offshore gambling services are prohibited. You are solely responsible for ensuring the legality of your activities.

  • Self-exclusion and responsible gambling queries: Requests relating to self-exclusion or responsible gambling tools can be initiated directly through the self-exclusion menu (Profile → Transactions → Self-Exclusion) or by contacting support through the Platform.
  • Legal and regulatory correspondence: Any formal legal notices or regulatory communications concerning Gamdom should be submitted via the contact channels indicated on the Platform from time to time, clearly marked as "Legal" or "Regulatory".
